1. Acceptance of Terms

By accessing or using Postbee ("the Service") located at https://postbee.online, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and Postbee ("we," "us," or "our"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

We reserve the right to modify these Terms at any time. Material changes will be communicated as described in Section 14 (Changes). Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

2. Service Description

Postbee is a multi-platform social media management dashboard that enables users to:

  • Connect and manage multiple social media accounts from a unified interface
  • Create, schedule, and publish content across connected platforms
  • Manage inboxes and messages from connected platforms
  • Access analytics and insights for connected accounts
  • Collaborate with team members (for team accounts)

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We do not guarantee that the Service will be available at all times or that it will be error-free.

3. Accounts and Teams

3.1 Account Registration

To use the Service, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must be at least 13 years of age (or the minimum age required in your jurisdiction) to create an account. By creating an account, you represent and warrant that you meet this age requirement.

3.2 Account Security

You are responsible for:

  • Maintaining the security of your account password and authentication credentials
  • Notifying us immediately of any unauthorized access or security breach
  • Using strong, unique passwords and enabling two-factor authentication when available

3.3 Team Accounts

If you create or join a team account, you may invite team members and assign roles and permissions. Team administrators are responsible for managing team members and ensuring compliance with these Terms by all team members.

You acknowledge that team administrators may have access to team data and content, and you grant necessary permissions for team collaboration features.

4. Connected Platform Rules

When you connect a social media platform to the Service, you agree to:

  • Comply with the terms of service, community guidelines, and policies of each connected platform
  • Use the Service only to manage accounts and pages for which you have proper authorization
  • Respect rate limits and usage restrictions imposed by connected platforms
  • Not use the Service to violate any platform's terms or policies

We are not responsible for any actions taken by connected platforms, including but not limited to account suspension, content removal, or API access restrictions. Your relationship with connected platforms is separate from your relationship with us.

If a connected platform revokes access or restricts API usage, we may be unable to provide certain features for that platform, and we are not liable for any resulting impact on your use of the Service.

5. Billing, Trials, and Refunds

5.1 Subscription Plans

The Service may be offered under various subscription plans with different features and pricing. We reserve the right to modify pricing and plan features with reasonable notice.

5.2 Free Trials

We may offer free trial periods for paid plans. Trials are subject to the terms specified at the time of enrollment. At the end of a trial period, your subscription will automatically convert to a paid plan unless you cancel before the trial ends.

5.3 Billing and Payment

Subscription fees are billed in advance on a recurring basis (monthly or annually, as selected). You authorize us to charge your payment method for all fees associated with your account.

You are responsible for providing accurate billing information and keeping it up to date. Failure to pay may result in suspension or termination of your account.

5.4 Refunds

Refund policies vary by plan and jurisdiction. Generally:

  • Refunds may be available within a specified period after initial purchase (e.g., 30 days)
  • Refunds are not available for partial billing periods or after cancellation
  • Refunds are processed in accordance with applicable consumer protection laws

5.5 Cancellation

You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until the end of the billing period.

6. Prohibited Uses

You agree not to use the Service to:

  • Violate any applicable laws, regulations, or third-party rights
  • Post, transmit, or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
  • Impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity
  • Engage in spam, phishing, or other fraudulent or deceptive practices
  • Interfere with or disrupt the Service or servers or networks connected to the Service
  • Attempt to gain unauthorized access to any portion of the Service, other accounts, or computer systems
  • Use automated systems (bots, scrapers) to access the Service without authorization
  • Reverse engineer, decompile, or disassemble any portion of the Service
  • Remove or alter any copyright, trademark, or other proprietary notices
  • Use the Service to violate the terms of service of any connected social media platform
  • Collect or harvest information about other users without their consent

Violation of these prohibitions may result in immediate suspension or termination of your account and may subject you to legal liability.

7. Intellectual Property and License

7.1 Our Intellectual Property

The Service, including its design, features, functionality, and content (excluding user content), is owned by Postbee and protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business purposes, subject to these Terms.

7.2 Your Content

You retain ownership of content you create, post, or transmit through the Service ("User Content"). By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and distribute your User Content solely for the purpose of providing and improving the Service.

You represent and warrant that you have all necessary rights to grant this license and that your User Content does not infringe any third-party rights.

7.3 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use, modify, and incorporate such feedback without compensation or attribution.

8. Third-Party Services

The Service integrates with third-party social media platforms and other services. Your use of these third-party services is subject to their respective terms of service and privacy policies.

We are not responsible for the availability, accuracy, or practices of third-party services. We do not endorse and are not liable for any content, advertising, products, or services available from third parties.

Any issues or disputes with third-party services should be directed to the respective service provider.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
  • WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF VIRUSES
  • WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF CONTENT OR INFORMATION

We do not warrant that the Service will meet your requirements or that any errors will be corrected. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL POSTBEE, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, REVENUE, DATA, OR USE
  • BUSINESS INTERRUPTION OR LOSS OF BUSINESS OPPORTUNITIES
  • DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE SERVICE

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so some of the above limitations may not apply to you.

11. Indemnity

You agree to indemnify, defend, and hold harmless Postbee, its affiliates, directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property or privacy rights
  • Your User Content
  • Your violation of any connected platform's terms of service

We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, at your expense.

12. Termination

12.1 Termination by You

You may terminate your account at any time by canceling your subscription (if applicable) and deleting your account through account settings or by contacting us.

12.2 Termination by Us

We may suspend or terminate your account immediately, without prior notice, if:

  • You violate these Terms or our acceptable use policies
  • You engage in fraudulent, illegal, or harmful activities
  • You fail to pay required fees
  • We are required to do so by law or court order
  • We discontinue the Service or a portion thereof

12.3 Effect of Termination

Upon termination:

  • Your right to use the Service immediately ceases
  • We may delete your account and data, subject to our data retention policies and legal obligations
  • You remain liable for all fees incurred prior to termination
  • Sections of these Terms that by their nature should survive termination will remain in effect

13. Governing Law and Venue

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be resolved in accordance with applicable law, and you consent to the personal jurisdiction of such courts.

If you are a consumer in the European Union, you may also have rights under the laws of your country of residence, and nothing in this section limits those rights.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated by:

  • Posting the updated Terms on this page
  • Sending an email notification to the address associated with your account
  • Displaying a prominent notice within the Service

Your continued use of the Service after such changes constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and may terminate your account.

15. Miscellaneous

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings.

15.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

15.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or internet or telecommunications failures.
